利用規約

These Terms apply to everyone who uses the Service: those who design and hand out cards (“Creators”) and those who receive them (“Fans”). By using the Service you agree to these Terms.

1. Creators sign in with an Apple or Google account. Fans can receive cards without creating an account.
2. A Creator’s display name and URL name are shown on the card’s download page and on the card, and can be seen by others.
3. Creators are responsible for managing their accounts.

1. Rights in the images, text, links and other content a Creator registers (“Content”) remain with the Creator or the rightful owner.
2. We may use the Content free of charge to the extent necessary to provide the Service (including generating, distributing and displaying cards, showing download pages and resizing images).
3. Creators warrant that they hold, or have permission for, all rights required for the Content (copyright, portrait rights, trademarks and others).

1. The issuer of a card is the Creator. Perks, communication and any other relationship between a Creator and Fans are for them to arrange.
2. The name a Fan puts on a card cannot be changed after adding it. It is shown on the card and can be seen by the Creator who handed it out.
3. As a rule, one card per device. Adding the same card again on the same device voids the earlier one.

Users must not:

1. break the law or public order and morals;
2. infringe copyright, portrait rights, trademarks, privacy or other rights of others;
3. impersonate others or suggest a false connection with us or any organisation;
4. defame others or promote discrimination;
5. register obscene, violent or otherwise offensive content;
6. register personal information of others without their consent;
7. use cards or download pages for fraud, solicitation or to deceive others;
8. interfere with the Service, access it without authorisation or place excessive load on it;
9. do anything else we consider inappropriate.

A card’s download page can be viewed by anyone who knows its URL and may appear in search engines. Creators can turn the public link off on the Share page.

If you find content that breaches these Terms, please contact us (Article 13). If we judge that content breaches these Terms, we may without notice hide or delete it, stop the public link, suspend the account or take other necessary measures.

1. The Service has a free Free plan and paid Standard (JPY 980 per month) and Pro (JPY 2,980 per month) plans. The number of designs, the number of cards that can be handed out (counted by device) and the features of each plan are as shown on the Plan page.
2. Fees are paid by credit card through Stripe, Inc. We do not receive card numbers.
3. Paid plans renew automatically every month. Creators may cancel at any time and keep the paid plan until the end of the period already paid for.
4. When the card limit is reached, new adds stop, but cards already handed out keep working. Cancelling or changing plans may make some features unavailable, such as updating cards already handed out.
5. As a rule, fees are not refundable. If something does not work, please contact info@virtual-cross.com.

We may change, suspend or end the Service without notice. If the Service ends, cards already in Apple Wallet or Google Wallet stay on devices but may no longer update. We will give reasonable advance notice before ending paid plans.

1. We do not warrant that the Service fits any particular purpose or will be provided without interruption. How cards are shown and updated in Apple Wallet and Google Wallet may depend on Apple’s and Google’s specifications and device settings.
2. Our liability for damages arising from our negligence (excluding gross negligence), whether in contract or tort, is limited to ordinary and direct damages actually incurred by the user. For users of paid plans, it is further limited to the fees the user paid us in the month the damage occurred.
3. The preceding paragraph does not apply where the Consumer Contract Act or other laws do not allow our liability to be wholly or partly excluded.
4. Disputes between Creators and Fans, or between users and third parties, are to be settled between them, except where we are at fault.

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance. However, where the user is a consumer, this Article does not prevent the user from bringing an action in a court competent under the law.

We may change these Terms as needed. Changes take effect when posted on this page. We will announce important changes that are disadvantageous to users in advance on the Service.
